Federal Trade Commission v. Netscape

U.S. District Judge Marilyn Patel denied the Federal Trade Commission's motion to compel Netscape Communications Corp. to produce documents containing subscriber information.  In a case of first impression, Judge Patel ruled that a pretrial discovery subpoena is not one of the mechanisms that a government entity may use to obtain subscriber information under the Electronic Communications Privacy Act ("ECPA").
