Junk E-mail Decisions and Litigation

Cyber Promotions v. WorldCom Press Release

Philadelphia 6-24-97 --- Infamous bulk emailer, Cyber Promotions, today filed a lawsuit against Internet Service Provider giant, WorldCom. The complaint alleges that WorldCom was in breach of a three year Internet service agreement with Cyber when it terminated the contract with no prior notice. Cyber has asked the court to hand down a permanent injunction which would force WorldCom to provide Cyber with Internet connectivity for the duration of the three year contract. WorldCom had also signed an addendum that acknowledged Cyber's bulk email practices.

Cyber Promotions' president, Sanford Wallace commented: "If you don't want your customers to send commercial email, then don't sign a contract that gives them permission to do so. Our message is quite clear. If you terminate a binding contract, be prepared to deal with the consequences."
