Junk E-mail Decisions and Litigation

SimpleNet v. VNZ Information & Entertainment Services

On November 13, 1997, SimpleNet, a leading low-cost Internet presence provider filed suit against a group of small San Diego-based companies and individuals, most notably VNZ Information and Entertainment Services. The suit seeks an injunction of unsolicited or "spam" email advertisements and punitive and compensatory damages from the group on several counts, due to lost revenue and loss of reputation. Interestingly, this legal action asks the San Diego County District Attorney's Office to investigate the possibility of
bringing criminal charges under the California Data Access and Fraud
Act.
