Junk E-mail Decisions and Litigation

AOL v. Prime Data Worldnet Systems, Inc.

In October 1997, AOL filed suit against Prime Data Worldnet Systems, Inc. and Vernon N. Hale charging the defendants flooded the AOL system with junk e-mail.  A federal court  entered a judgement for AOL in this case after Prime Data Worldnet and its founder, Vernon Hale, failed to contest AOL's charges.  The Court ordered the defendant to pay damages, noting the "malicious" nature of the defendants conduct warranted triple punitive damages.   Additionally, the Court provided AOL injunctive relief and barred the defendant from sending e-mail to AOL or its members.  In a related issue Floodgate's author, Neil Albala was held in contempt of court.
