Junk E-mail Decisions and Litigation

AOL v. Forrest Dayton, et al.

In December 1998, AOL filed suit against Forrest Dayton for transmitting billions of deceptive, unsolicited, and unwanted electronic mail messages to  AOL members.  Despite requests to cease these activities, Defendants continued to send junk e-mail to AOL members employing numerous deceptive practices to mask their identities and the source and quantity of their transmissions.  On December 28, 1999 Judge Claude M. Hilton awarded AOL a total of $1.2 million in monetary damages and permanently enjoined Forrest Dayton from directly or indirectly engaging in the transmission of unsolicited bulk e-mail messages to AOL members.
