Junk E-mail Decisions and Litigation

AOL v. Cyber Promotions

AOL, its mail servers swamped by undeliverable junk e-mail, received numerous complaints from its members about unsolicited advertisements from Cyber Promotions. In response, AOL blocked e-mail coming in from Cyber Promotions. The spammer filed suit in U.S. district court in Pennsylvania. Cyber Promotions argued that it had a First Amendment right to send junk e-mail and that AOL had no right to restrict its ability to send junk e-mail. The District Court ruled in AOL’s favor in two separate decisions.
