Junk E-mail Decisions and Litigation

Concentric Networks v. Cyber Promotions

Internet service provided, Concentric Network Corp. (“CNC”), filed suit against Cyber Promotions to stop the spam mogul from using dummy CNC e-mail accounts to dump massive amounts of undeliverable junk e-mail into the CNC system. In similar fashion to CompuServe and AOL, CNC alleged trespass to personal property and unfair competition. CNC also alleged violations of the Electronic Communications Privacy Act as well as the Computer Fraud and
Abuse Act. The federal district court in San Jose, California ordered Cyber Promotions to stop using Concentric to send or receive e-mail.
