AOL v. The Christian Brothers and Jason Vale

On December 18, 1998, AOL sued the group, The Christian Brothers, and its president, Jason Vale in its continuing battle against unsolicited bulk e-mail. The Judge in that case, Southern District Magistrate Judge Deborah A. Batts, entered a default judgment after Christian Brothers failed to answer or move against AOL's complaint.

In a recommendation stemming from the default judgment, Southern District Magistrate Judge Henry Pitman ruled that AOL was entitled to recover for unjust enrichment since Christian Brothers unlawfully used the AOL mark and misappropriated services that otherwise could have been sold to advertisers.

The Report and Recommendation was followed up in January 2000 by an Order Adopting the Report and Recommendation and an Order denying the Defendant's motion to vacate default.
