National Football League, et al. v.
Ken Miller d/b/a NFL Today

A federal judge for the Southern District of New York has ruled that the operator of the web site NFLToday.com can be sued by the National Football League in New York, even though the site's alleged trademark and copyright infringements occurred in California.  Noting that "the mere maintenance of a web site in a distant state that was visited by people in New York did not subject the defendant to jurisdiction in New York," Judge John S. Martin, Jr. found that because the operator of NFLToday.com earned substantial income from interstate commerce, he was subject to the jurisdiction of courts in other states.
